1. Introduction

The privacy of individuals and the security of their personal data are important to MSP Nordics, which is responsible for ensuring that all personal data is processed properly and in accordance with applicable data protection legislation. This privacy policy (“Privacy Policy”) describes MSP Nordic's processing of personal data. We therefore ask you to read the Privacy Policy carefully before sharing personal data with us.

2. Areas of application of the Privacy Policy

2.1 To whom does the policy apply

This Privacy Policy applies to individuals who are candidates, employees, customers, suppliers and other stakeholders. Different chapters will be relevant to you depending on your relationship with MSP Nordics.

2.2 For the purposes of the policy

This Privacy Policy governs how MSP Nordics collects and processes personal data for our service offerings, which are license sales, rental, recruitment, consulting and other related activities (the “Service”). The policy also governs the processing of personal data of individuals at the parties with which MSP Nordics has a business relationship, such as suppliers and customers.

2.3 Does not apply to the policy

Sometimes MSP Nordics services are advertised on third-party websites that are not owned or managed by MSP Nordics. MSP Nordics has not reviewed these websites or other websites that contain links to MSP Nordic's website. This Privacy Policy does not apply to the processing of personal data that takes place on such websites and MSP Nordics is not responsible for the processing of personal data on websites that are not part of MSP Nordic's website. MSP Nordic's privacy policy also does not apply to processing carried out by test companies.

3. Processing of personal data

MSP Nordic's handling of personal data is described below based on your relationship with MSP Nordics.

3.1.1 Purposes of the processing of personal data

Personal data is processed only for the purposes and purposes described in this Privacy Policy. If you choose not to provide us with certain personal data, it may affect the Service. MSP Nordics processes personal data only to the extent such processing is necessary for the Service or for such other purposes as set out below. This also applies to sensitive personal data.

MSP Nordics processes the personal data of job seekers and employees in order to:

(a) provide the Service to MSP Nordic's customers and offer you the opportunity to be a part of the Service;
(b) administer our relationship with you;
(c) handle any cases of alleged discrimination; handle disputes and complaints against you or MSP Nordic's customers and suppliers; and conduct internal demographic studies and optimize MSP Nordic's operations.

3.1.2 Personal data

By reading this Privacy Policy, you agree that MSP Nordics will process your personal data in accordance with this Privacy Policy. If you do not want us to process your personal data or consent to such processing, you should not provide us with personal data.
Below you will find information about the types of personal data MSP Nordics processes and how MSP Nordics may obtain/collect this data.

3.1.2.1 Candidate

The personal data MSP Nordics processes about you as a candidate is based on the data you provide to MSP Nordics via MSP Nordic's website or through contact with MSP Nordic staff for MSP Nordic's provision of the Service. MSP Nordics will not process your personal data without first giving your consent by accepting MSP Nordic's Privacy Policy.

The personal data we may process about you consists of, among other things, your name, address, email address, social security number, grades, certificates, educations and work experiences, photograph, test results, background check data, drug test results, data from a reference person (such as reviews and health, such as sick leave notes) and information necessary for follow-up of the Service, etc. In case you intend to become photographed or that you leave a photograph of yourself without prompting from MSP Nordics, you agree that MSP Nordics deals with such photography.

It may be that, in connection with the conduct of tests, at our request, you may be required to agree to additional terms and conditions for the processing of your personal data.
Due to the fact that some of MSP Nordic's customers place high security requirements on individuals, MSP Nordics may in some cases need to perform background checks, credit checks, health checks and/or drug tests on you. Such checks may contain sensitive personal data about you and you will provide specific consent before a background check, credit check, health check or drug test is performed/to be performed.

As part of a background check, MSP Nordics may ask you to submit an extract from the load register. It is you yourself who order such an extract from the relevant authority. It is always up to you to decide whether you want to order a load register extract. If you choose to opt out, it may affect your ability to be updated for the Service. The statement will be opened by you together with MSP Nordic and/ MSP Nordic's customer. The information contained in a load register extract is handled with the utmost confidentiality and will never be processed by MSP Nordics. However, MSP Nordics may verbally reconcile the results with MSP Nordic's customer in order to provide the Service.
It may also be necessary in certain situations for MSP Nordics to obtain your consent to request credit information through an external credit reporting company.
MSP Nordics may also ask you to provide additional personal data, but in such cases you will specifically consent to this. Also personal data that is given/processed by special consent will be subject to this Privacy Policy.

3.1.2.2 Employees

The personal data we will process about you consists of, in addition to the data specified in paragraph 3.1.2.1 (Candidate), including salary and account details.

MSP Nordics may also need to process sensitive personal data about you, such as data about your health. For example, health data may need to be processed in order for MSP Nordics to meet its obligations as an employer.

3.1.3 Storage of personal data

The length of time a personal data is stored depends on the personal data in question and the purpose of its processing. The data that you register in your profile or that MSP Nordics records in MSP Nordic's business system will be stored for as long as your account is active, during an ongoing contractual relationship and thereafter, in some cases, for a period governed by law. Your account is considered inactive if you have not logged into it for such a long period that gives MSP Nordic reasons to believe that your personal data has become out of date, you do not have an employment relationship with MSP Nordics, or you have withdrawn your consent to MSP Nordic's processing of your personal data.

MSP Nordics will, as a general rule, retain personal data until the legal basis for the document ceases.

3.2 For you as a customer or supplier

3.2.1 Purposes of the processing of personal data

Personal data is processed only for the purposes and purposes described in this Privacy Policy. If you choose not to provide us with certain personal data, it may affect the use of the Service or the provision of the Service.
MSP Nordics processes personal data only to the extent such processing is necessary for the Service and for services provided by suppliers to MSP Nordics or for such other purposes as set out below. This also applies to sensitive personal data.

MSP Nordics processes personal data about the employees of customers and suppliers in order to:

(a) you should be able to access the Service or provide other services to MSP Nordics;
(b) manage our relationship with you;
(c) MSP Nordics shall be able to manage its obligations to you or the individual concerned, handle cases of alleged discrimination, handle disputes and complaints matters; and enable future business relationships.

3.2.2 Personal data

By reading this Privacy Policy, we inform you that you consent to MSP Nordics processing, as applicable, personal data about your employees and/or suppliers in accordance with this Privacy Policy. You also confirm that prior to giving your consent, you have received consent for MSP Nordic's processing of personal data in accordance with this Privacy Policy from all interested individuals. MSP Nordics may also request that the individual provide additional personal data than stated below. Also personal data that is given/processed by special consent will be subject to this Privacy Policy.

3.2.2.1 Customers

MSP Nordics may process personal data of contact persons. Such information consists, inter alia, of name, address, e-mail address, position, responsibilities and other information necessary for the provision and follow-up of the Service and to enable future business relationships.

3.2.2.2 Suppliers

MSP Nordics may process personal data of contact persons and other employees. Such personal data consists, inter alia, of the data specified in paragraphs 3.2.2.1 (Customers) and 3.1.2.1 (Candidate) and other data necessary for the provision and follow-up of the Service, to ensure a good delivery of services to MSP Nordics and to enable future business relationships.

3.2.3 Storage of personal data

The length of time a personal data will be stored depends on the personal data in question and the purpose of its processing. MSP Nordics does not store personal data for a longer period than is necessary for the purposes for which it was collected, unless otherwise provided by law.
The data that you as a supplier register in your profile (s) or that MSP Nordics records in MSP Nordic's business system, after approval from you or the individual concerned, will be stored for as long as the respective account is active or during an ongoing contractual relationship. An account is considered inactive if no one has logged into it for such a long period that gives MSP Nordic reasons to believe that the personal data has become out of date or that consent to the processing has been withdrawn.

3.3 Personal data for marketing purposes

The consent given also covers that the information you provide to MSP Nordics may be used by MSP Nordics for marketing and market research purposes to provide candidates, employees, customers and suppliers with a better experience and improve and optimize the quality of the Service (for example, by displaying content that may be of interest to you and delivering more relevant information to you).
In the event that you no longer wish to receive marketing, you can contact us and indicate that you do not wish to be contacted for marketing purposes.

3.4 Use of MSP Nordic's website and cookies

4. Protection of personal data

MSP Nordics has taken appropriate technical and organizational measures to protect personal data against loss, misuse, unauthorized access, disclosure, alteration and destruction. To ensure that personal data is processed in a secure and confidential manner, we use data networks that are intrusion-protected with, among other things, firewalls and industry-standard password protection. In order to ensure the privacy of the personal data you provide over the Internet, we may use encryption technology when we transfer such personal data over the Internet to our servers. MSP Nordic's employees and suppliers are bound by confidentiality agreements and are obliged to comply with MSP Nordic's information and IT security rules, this Privacy Policy and other internal regulations that further regulate the processing of personal data.

5. Sharing of personal data outside companies in MSP Nordics

MSP Nordics will not sell, disclose or distribute personal data to third parties, except as set out in this Privacy Policy. Within the framework of the Service, personal data may be passed on to an MSP Nordic customer, suppliers, subcontractors, and partners if necessary for the performance and provision of the Service. MSP Nordics may also disclose your personal data to other third parties, such as MSP Nordic's suppliers for our business, for example for payroll administration, technical support, operation of IT systems, external testing companies or suppliers who handle job searches on our behalf. Parties to which MSP Nordics may disclose personal data may be located outside the European Economic Area (EEA), which means that personal data may be transferred to countries outside the EEA. If MSP Nordics discloses personal data to MSP Nordic's suppliers outside the EEA, we will take steps to ensure that the personal data continues to be protected and also take the necessary steps to legally transfer personal data to countries outside the EEA.

Furthermore, we may disclose personal data if we are required to do so under applicable law, court order or if such disclosure is otherwise necessary to participate in a judicial investigation. In the event that MSP Nordics is subject to a reorganization, merger or sale, we may transfer personal data to the relevant third party, provided that the third party undertakes to process the personal data in accordance with this Privacy Policy.

7. Your rights

You as an individual have the right to receive information free of charge, once per calendar year, following a signed application sent to MSP Nordics at the address above (under “Data Controller”) about the personal data that MSP Nordics processes about you and information about the scope and purpose of such processing. You as an individual also have the right to request that we block, delete or correct your personal data at any time. You always have the right to withdraw your consent and notify us that you object to the continued processing of your personal data.

8. Modifications to this Privacy Policy

MSP Nordics reserves the right to revise this Privacy Policy from time to time. The date of the last change is indicated at the end of the Privacy Policy. If we make any changes to the Privacy Policy, we will post those changes on the Website. You are therefore advised to read this Privacy Policy regularly to be aware of any changes. If we change the Privacy Policy in a way that is significantly different from what was stated when your consent was collected, we will notify you of these changes and, if necessary, ask you to re-consent to MSP Nordic's processing of personal data.
